1. Services Provided
Prime Excavating specializes in excavation, grading, site preparation, trenching, and related construction services. Our services are provided under agreed-upon contracts and scopes of work.
2. Estimates and Payments
- Estimates provided by Prime Excavating are valid for [X] days from the date of issuance.
- A deposit may be required before work commences, with the balance due upon completion.
- Payment terms must be adhered to as per the signed contract.
- Late payments may be subject to additional fees and interest.
3. Project Timelines

- Prime Excavating will communicate any changes to the project timeline promptly.
4. Customer Responsibilities
- The customer must ensure the job site is accessible and free from obstructions.
- Necessary permits and approvals must be obtained by the customer unless otherwise stated in the contract.
- Any changes to the agreed scope of work may result in additional charges.
5. Liability and Insurance
- Prime Excavating maintains appropriate liability insurance coverage.
- We are not liable for damages resulting from pre-existing site conditions, underground utilities not disclosed by the customer, or any work performed outside the agreed scope.
- The customer is responsible for providing accurate information regarding underground utilities or obstacles.
6. Warranty and Guarantees
- Workmanship is guaranteed for [X] days after project completion.
- Any defects or issues must be reported within this period to be considered for repairs or adjustments.
- This warranty does not cover damages caused by natural disasters, third-party work, or misuse of the completed excavation.
7. Termination of Services
- Prime Excavating reserves the right to terminate services if the customer breaches the contract, fails to make payments, or creates unsafe working conditions.
- The customer may terminate the contract under agreed terms and may be subject to cancellation fees.
8. Force Majeure
- Prime Excavating is not responsible for delays or inability to perform due to unforeseen events beyond our control, including natural disasters, labor strikes, government actions, or other emergencies.
9. Dispute Resolution
- Any disputes shall first be addressed through direct communication and negotiation.
- If unresolved, disputes will be handled through mediation or arbitration in Utah, Washington County jurisdiction.
10. Governing Law
These Terms and Conditions are governed by and interpreted under the laws of Utah.
11. Changes to Terms and Conditions
Prime Excavating reserves the right to update these Terms and Conditions at any time. Customers will be notified of significant changes.
